Can Debt Collectors Call You at Work?

Under the Fair Debt Collection Practices Act (FDCPA), debt collectors are generally prohibited from contacting you at your place of employment if they know or have reason to know that your employer disapproves of such communications.

What the Law Says

The FDCPA, codified at 15 U.S.C. § 1692c(a)(3), states that a debt collector may not communicate with a consumer at their place of employment if the debt collector knows or has reason to know that the consumer's employer prohibits the consumer from receiving such communication.

How to Stop Workplace Calls

  • 1. Tell the collector verbally that you cannot receive calls at work. Under the FDCPA, once you inform the collector, they must stop calling your workplace.
  • 2. Follow up in writing. Send a written notice to the debt collector stating that you are not permitted to receive calls at your place of employment.
  • 3. Document everything. Keep a record of every call, including the date, time, caller name, and what was said.

What If They Keep Calling?

If a debt collector continues to call your workplace after you have informed them to stop, this may constitute a violation of the FDCPA. Consumers who experience FDCPA violations may be entitled to statutory damages of up to $1,000 per lawsuit, plus actual damages and attorney's fees.
